Rules of the marketing competition "Free braces every week"

I. Introductory provisions

1. The organizer of the marketing competition called "Every week free braces" (hereinafter referred to as the "Competition") is the business company Svět rovnátek s.r.o., with its registered office at Nad Vršovskou hora 1423/10, Michle, 101 00 Prague 10, ID No.: 186 27 218, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 1857 (hereinafter referred to as the "Organizer").

2. The Promoter issues these Competition Rules which govern the binding terms and conditions of the Competition (the "Rules"). By entering the Competition, the entrant agrees to these Rules and undertakes to comply with them.

II. Duration of the Competition

The Competition runs from 7.4.2025 to 4.5.2025 (the "Competition Period"). 

III. Conditions for entry into the Competition

1. The Competition will include all natural persons with a delivery address in the Czech Republic who, during the Competition Period, enter into a Health Care Contract with the Promoter themselves or through their legal representative (in the case of minors), the subject of which is the treatment with invisible braces, and also commence treatment during the Competition Period, i.e. fulfil the terms of the concluded contract (hereinafter referred to as the "Participant").
   

2. Each Participant may participate only once.
   

3. The winner will be decided by lottery.
   

4. 1 winner and 1 alternate will be drawn for each week of the Contest Period, i.e. 4 winners and 4 alternates in total.

IV. Prizes and determination of winners

1. The prizes in the Competition are 4x invisible braces (" Prize").
   

2. The draw will take place using an automated script. The draw will take place every Monday of the calendar week following the calendar week for which the winner and alternate are drawn, i.e. 14.4., 21.4., 28.4. and 5.5.2025.

V. Notification of Winning and Delivery of Winnings

1. Each Winner will be contacted by the Promoter by e-mail no later than 3 working days from the date of the draw referred to in the preceding article of these Rules to the e-mail address provided as the contact details of the Promoter (" E-mail"). The Winner must reply to the e-mail from the Promoter within 5 working days of receipt of the e-mail stating whether he/she accepts or rejects the Prize. If he/she fails to respond, such Winner will be eliminated and the Promoter will contact the winning alternate Winner.
   

2. The prize in the form of a gift voucher will be sent to the winners by E-mail within 14 days of the end of the competition. 

VI. Notification of the processing of personal data

1. The Promoter is the controller of the personal data of the Competition Participants. The personal data of the Competition Participants will be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, General Data Protection Regulation (hereinafter referred to as "GDPR") and Act No. 110/2019 Coll., on the processing of personal data, as amended.
   

2. The Promoter will process the personal data of the Competition Participants for the following purposes:

• for the purposes of the Competition, for the purpose of evaluating the Competition, informing the Competition Participant of the award and delivery of the Prize;
• the provision of health services (orthodontic treatment) on the basis of the Health Care Contract;
  

3. The Promoter will process the Entrant's personal data to the following extent:

• first name + surname, birth number + date of birth;
• contact details (address, email + phone number);
• the insurance company with which the Participant has his/her health insurance;
• an anamnestic questionnaire (includes information on any chronic or infectious diseases, bad habits, type of toothbrush used, etc.);
• medical records from the Participant's visits to the Organiser (photo documentation and X-rays, digital scans of teeth).

4. The recipients of an Entrant's personal information will be authorized employees of the Promoter and Align Technology Inc., 2820 Orchard, Parkway San Jose, California 95134, telephone 408-407-1000, manufacturer of invisible braces.

5. The Participant's personal data will be processed for the period of time stipulated by the relevant legal regulations.

6. Each Participant has the right to access his/her personal data and to correct, delete, restrict their processing, the right to their portability, the right to object to their processing, as well as the right to withdraw consent to their processing at any time. The participant has the right to lodge a complaint with a supervisory authority if he/she considers that the processing of his/her personal data violates the provisions of generally binding legal regulations.

7. The Entrant's personal data will be processed in accordance with the Organiser's Personal Data Processing Rules. These rules are published at www.svetrovnatek.cz

VII. Final Provisions

1. Employees of the Promoter or persons in any other similar relationship to the Promoter and persons close to such persons within the meaning of Section 22 of Act No. 89/2012 Coll., the Civil Code, as amended, are excluded from participation in the Competition.
   

2. By participating in the Competition, the Participant is not legally entitled to the Prize. The Prize cannot be claimed in court.

3. The prize cannot be paid in cash or exchanged for any other monetary or non-monetary consideration.

4. The Winner is fully responsible for meeting any tax obligations arising from the tax regulations of the Czech Republic that may be associated with the acceptance of the Prize.

5. The Promoter shall not be liable for any defects or damages arising in connection with the implementation and use of the Prize.

6. The Promoter has the right to change the terms and conditions of the Competition at any time, including during the Competition, to change the Competition Period, i.e. in particular to extend, interrupt or terminate the Competition early during the Competition. Any claims or objections shall be finally decided by the Promoter.

7. The Promoter reserves the right, without further delay, to disqualify from the Competition Entrants who are found or reasonably suspected of violating these Rules or failing to comply with the conditions for participation in the Competition, or who share vulgar, offensive, racist or otherwise inappropriate statements or posts that are contrary to good manners or damage the reputation of the Promoter, without any compensation.

8. The Promoter reserves the right to change the Prize if it is unable to deliver the original Prize to the Winners for reasons beyond its control.

9. The Promoter reserves the right to change these Rules. Any change to the Rules will be announced by the Promoter in the same manner as the Competition was announced by the Promoter and will be effective from the time of publication.
